APC National Legal Adviser describes attempt by unregistered members to remove nat’l chairman is fraudulent By David Lawani, Abuja For the drama that has kept the national chairman of the All Progressives Congress, APC, Dr Abdullahi Ganduje to lock horns with some alleged New Nigeria People’s Party, NNPP, members in Kano who are baying for his head, the National Legal Adviser of the party, Professor Qbdukarim Kana has described the attempt by those unregistered members of the party to removed chairman as fraudulent. Kana made this assertion when he addressed pressmen at the media center of the party stating that it is obvious the judge who granted the exper te order acted on fraudulent documents because it is his duty to hear from the other parties to the issue before arriving at his conclusion. He accused the judge further saying he had compromised otherwise he would have made efforts to listen to all the party before drawing conclusions. He noted however that the excos of the party in Kano are doing everything possible to write the national Judicial Council, NJC to invite the judge who granted the other without listening to the other party to the issue. He said: ” We have said it. No one has appeared before the court. No one has gone to court yet. If a judge decided on his own to listen to one side, without hearing the other or without inviting the parties who are mentioned in the process, and then follows the order with a threat, you know that, that is a judge that is interested on the case. It means that the judge has been compromised. Speaking further on whether going by the constitution of the APC if ward Excos have the power to remove the national chairman of the party, Professor Kana noted: ” I will not answer the question because the persons who purportedly suspended the chairman are not even registered members of the party. We have not made that statement. First of all, you have to be a member of the party before you can suspend anybody. ” If the judge is not compromised, why will he dabble into this matter? We all know what the supreme court has said regarding internal affairs of the party. In the first case, it is the issue of jurisdiction. And you should know as a judge. I am not engaging on the pages of newspaper but as a judge he should know. ” The court has no jurisdiction. Two, the persons who purportedly appeared before Judge is a fraud. One of the plaintiffs whose name appeared there is here with us. He is here in Abuja right now and his name appeared everywhere. So, where are they getting all this from? But I think they have gone too far. The court has also gone too far. It is not the first time if you may recall. The point is that never again would this repeat itself. ” But whatever kind of order that will emanate from such document will be one obtain by fraud. And all of us know even a 100 level law student kolnows. The order obtained by those guys from the court is an unlawful order not enforceable. It will not be recognised and respected. Because it will be obtained by default..The individuals who are behind it are not APC members. ” They are not members of Ganduje Ward or any APC excos of any ward fir that matter. We don’t know them. And that remains our position. In addition to the complaint that was lodged with the police, the Ganduje Ward excos are also going to National Judicial Council, to submit a petition against the judge who granted the exper te order. If an order obtained by fraud, any court will tell you that an order obtained by fraud is a nullity abinitio. ” This are ordinary some of the people that are supposed to be involved in some of the issues that are going on. We immediately file a complaint with the police and a copy was served on the IGP to investigate the individuals who were behind it. ” Particularly the local government ward Excos no exception not a single one is missing had showed up to say they are not aware of that action.
